Terms of Use

Please read these Terms of Use (the “Terms”) carefully before using gamblersay.ca (the “Site”) or any related services provided by GamblerSay (“we,” “us,” or “our”) (collectively, the “Services”). These Terms constitute a legally binding agreement between you and GamblerSay governing your access to and use of the Services.

By accessing the Site, creating an account, submitting a review, or otherwise using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must immediately discontinue use of the Services.

GamblerSay is a user-generated content (UGC) platform that aggregates and publishes community reviews of online casinos for gamblers. Our role is that of an independent platform operator; we do not endorse, recommend, or affiliate with any specific casino operator unless explicitly disclosed.

1. Eligibility

Access to the Services is restricted to individuals who meet all of the following criteria:

  • You are at least 18 years of age, or the minimum legal gambling age in your province of residence, whichever is higher.
  • You have the legal capacity to enter into a binding agreement under applicable law.
  • You are not prohibited from accessing online gambling-related content under the laws of your jurisdiction.
  • You are accessing the Services for lawful purposes only.

By using the Services, you represent and warrant that you satisfy all eligibility requirements set out above. We reserve the right to terminate or restrict access for any user who does not meet these criteria or who provides false information regarding their eligibility.

The Services are directed at residents of Canada. Users accessing the Site from outside Canada do so at their own risk and are solely responsible for compliance with local laws.

2. Account Registration

Certain features of the Services, including the ability to submit reviews, require you to create an account. When registering, you agree to:

  • Provide accurate and complete information. You may use a pseudonym or nickname in place of your legal name.
  • Maintain the confidentiality of your login credentials and not share them with any third party.
  • Notify us promptly at [email protected] if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account, whether or not you authorised it.

We reserve the right to suspend or terminate accounts that violate these Terms, appear to have been registered fraudulently, or are associated with manipulative review activity. Account creation does not confer any proprietary or ownership interest in the platform or its content.

3. User-Generated Content

3.1 Your Submissions

GamblerSay enables you to submit reviews, ratings, comments, and supporting media files (“User Content”). All User Content you submit must comply with these Terms and our Moderation Policy. By submitting User Content, you confirm that:

  • The content reflects your own genuine, first-hand experience with the casino or service you are reviewing.
  • You hold all rights necessary to submit the content, including any images or screenshots, and that doing so does not infringe the intellectual property rights of any third party.
  • The content does not contain false or defamatory statements, hate speech, personal threats, or any material that is unlawful under applicable law.
  • You have not been offered or received any form of remuneration, incentive, or direction from a casino operator or third party in exchange for submitting the review.

3.2 Licence Grant

By submitting User Content to the Services, you grant GamblerSay a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, host, store, reproduce, display, publish, distribute, and adapt your content in connection with the operation and promotion of the Services. This licence does not transfer ownership of your content. You retain all moral rights you hold in your submissions, to the extent permitted by applicable law.

This licence continues even if you delete your account, as your published reviews form part of the community record and may be retained in anonymised form as described in our Privacy Policy.

3.3 Content Moderation

All submitted content is subject to pre-moderation by both automated systems and human moderators before publication. We do not guarantee that submitted content will be published. We reserve the right to decline, withhold, edit for formatting purposes only, or remove any User Content that violates these Terms or our Moderation Policy, without prior notice.

We do not remove negative reviews at the request of casino operators. If a review is removed, it is because it violates these Terms or our Moderation Policy, not because the content is unfavourable to a particular brand.

3.4 Accuracy of Submitted Content

You are solely responsible for the accuracy and completeness of the content you submit. GamblerSay does not independently verify the factual claims made in user reviews. The platform aggregates community opinion; individual reviews should not be treated as legal, financial, or professional advice. We encourage you to attach supporting documentation, such as screenshots or transaction records, to substantiate your claims.

4. Prohibited Conduct

You agree not to engage in any of the following activities in connection with the Services:

Inauthentic or Manipulative Reviews

  • Submitting reviews that do not reflect genuine, first-hand experience.
  • Submitting reviews on behalf of another person without their knowledge and consent.
  • Coordinating with others to submit multiple reviews intended to artificially inflate or suppress a casino’s rating.
  • Submitting reviews in exchange for payment, discounts, bonuses, or any other form of compensation from a casino operator or affiliated party.

Harmful or Unlawful Content

  • Posting content that constitutes defamation, harassment, intimidation, or hate speech directed at any individual or group.
  • Uploading material that infringes the copyright, trademark, or other intellectual property rights of any third party.
  • Including personal identifying information of third parties without their consent.
  • Posting content that promotes illegal activity.

Platform Abuse

  • Attempting to circumvent our moderation systems, including by creating multiple accounts to evade a suspension or ban.
  • Using automated tools, bots, or scripts to submit reviews, manipulate ratings, or interact with the Site in a manner inconsistent with human use.
  • Scraping, harvesting, or extracting data from the Site in bulk without our prior written consent.
  • Introducing malware, viruses, or any code designed to interfere with the operation of the Services.
  • Attempting to gain unauthorised access to any portion of the Services, our servers, or systems connected to the Site.

We reserve the right to investigate suspected violations, and to suspend or permanently ban accounts, remove content, and report unlawful conduct to relevant authorities where warranted.

5. Platform Independence and No Endorsement

GamblerSay operates as an independent aggregator of community-generated content. We do not test, audit, or certify the casinos listed on the Site. Casino profiles and associated ratings reflect community opinion at a given point in time and are subject to change as new reviews are submitted.

Users are responsible for conducting their own due diligence before registering with or depositing funds at any online casino.

The GamblerSay Score is a dynamic, community-driven metric. It is not influenced by commercial relationships with casino operators. No operator may purchase a higher rating or a “Top Rated” designation. If we introduce affiliate links or commercial partnerships in the future, these will be clearly and prominently disclosed, and they will have no effect on community-generated ratings.

6. Intellectual Property

All content on the Site that is not User Content, including the GamblerSay name, logo, platform design, software, editorial text, AI-generated summaries, and data compilations, is owned by or licensed to GamblerSay and is protected by applicable intellectual property law.

You may access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, or create derivative works from any GamblerSay-owned content without our prior written consent.

If you believe that content on the Site infringes your intellectual property rights, please contact us at [email protected] with sufficient detail to allow us to assess and respond to your claim.

7. Third-Party Links and Casino Platforms

The Site may contain links to external websites, including online casino platforms referenced in user reviews. These links are provided as a convenience to users and do not constitute an endorsement or affiliation. GamblerSay has no control over the content, privacy practices, or terms of third-party sites and accepts no responsibility for them.

Gambling involves financial risk. Accessing a casino platform through a link on this Site is entirely at your own discretion and risk. GamblerSay is not responsible for any losses, disputes, or issues arising from your engagement with any third-party casino or service.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis, without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, GamblerSay disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that:

  • The Services will be uninterrupted, error-free, or free from harmful components.
  • The information or content available through the Services is accurate, complete, current, or reliable.

User reviews represent the personal opinions of individual contributors. GamblerSay does not adopt or endorse those opinions. Nothing on the Site constitutes legal, financial, or professional gambling advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, GamblerSay and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Services, including but not limited to:

  • Loss of data, revenue, profits, or goodwill.
  • Reliance on any review, rating, or other content published on the Site.
  • Losses arising from your engagement with any third-party casino platform.
  • Unauthorised access to or alteration of your account or submissions.

Where liability cannot be fully excluded under applicable Canadian law, our total aggregate liability to you for any claim arising under these Terms shall not exceed one hundred Canadian dollars (CAD $100).

Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any other liability that cannot be excluded under mandatory Canadian law.

10. Indemnification

You agree to indemnify, defend, and hold harmless GamblerSay and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services in violation of these Terms.
  • Any User Content you submit, including claims that it infringes third-party rights or is defamatory or unlawful.
  • Your violation of any applicable law or the rights of any third party.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, at your expense. You agree to cooperate with us in asserting available defences.

11. Responsible Gambling

GamblerSay is an information and review platform, not a gambling operator. We do not facilitate wagering, accept deposits, or operate casino games. Nonetheless, given the nature of the content on the Site, we are committed to promoting responsible gambling awareness.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, and you hereby consent to the personal jurisdiction of such courts.

Before initiating formal proceedings, we encourage you to contact us at [email protected] to seek an informal resolution. We will make reasonable efforts to resolve disputes promptly and in good faith.

13. Modifications to the Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this document and, where appropriate, notify registered users by email or through a notice posted on the Site.

Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must discontinue use of the Services.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to other users, the platform, or third parties.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to access the Services ceases immediately. Sections of these Terms that by their nature should survive termination, including Sections 3.2, 6, 8, 9, 10, and 12, shall continue in full force and effect.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Moderation Policy, constitute the entire agreement between you and GamblerSay with respect to the Services and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any particular breach does not constitute a waiver of any subsequent breach.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction in connection with a merger, acquisition, or sale of assets.

15.5 Language

These Terms are drafted in English. In the event of a conflict between any translated version and the English version, the English version shall prevail.

Every gambler has a say. These Terms exist to make sure that say remains honest, protected, and worth listening to.
